Supplemented by the three-mile zone proposed by Cornelis van Bynkershoek in 1702, ‘Mare Liberum’ represents not only the basis for international maritime law but also for the freedom of trade. "Mare Liberum makes a plea for the right of Duch traders to freely access marketplaces and emporia in Asia by unimpeded and undisturbed navigation on the high seas. The freedom of navigation forms a subset to the overarching arguments on the freedom of access and trade" (P. Borschberg. p. 102). - Trimmed close at top and outer margin, only touching the top line on the last 2 pages and the printed margins on ca. 10 pages. Engr. bookplate 'Henry Paul'. Bound in 19th cent. full vellum, gilt title to spine, blindtooled fillet borders, gilt floral centerpiece, edges gilt; little soiled, small ink stain to front cover.

War erstmals 1609 anonym mit einem Umfang von nur 70 S. erschienen. "Mare liberum has come to be regarded as something of a visionary treatise acknowledging the need for a global trading regime with the free exchange of goods and persons both in times of war and especially also in peace. It does so by upholding the right of free trade as something so basic, so fundamental, so humankind, that it cannot be rightfully denied, curtailed or impeded. Mare liberum treats the high seas as vast pelagic spaces that remain in their natural state and cannot be appropriated by a sovereign, let alone by an individual" (P. Borschberg. Ausgehend von der Kaperung des portugiesischen Schiffs 'Santa Caterina' im Februar 1603 durch 3 Schiffe der VOC vor Singapur wurde Grotius von der Gesellschaft beauftragt eine Verteidigung dieser Beschlagnahmung zu verfassen. Er griff dabei auf einen Abschnitt seiner unveröffentlichten Arbeit 'De jure Praedae' zurück, die er zu einer allgemeinen Verteidigung der Freiheit des Handels auf den Weltmeeren gegen die 'Mare clausum' Doktrien der englischen, portugiesischen und spanischen Kolonialmächte erweiterte. Ergänzt um die 1702 von Cornelis van Bynkershoek vorgeschlagene Drei-Meilen-Zone, stellt 'Mare liberum' die Grundlage für das internationale Seerecht dar. - Am Kopf und außen etwas knapp beschnitten, auf den beiden letzten Seiten die Oberlängen der ersten Zeile berührend, auf ca. 10 Seiten die gedruckten Marginalien gering angeschnitten. - Gest. Exlibis für Henry Paul mit dem Wahlspruch "Pro rege et republica", wohl aus der Familie Paul, baronets of Rodborough, Gloucestershire.
